Right of Way Permit for Trails

Authorized in 2004, Kitsap County County Code requires a Right of Way Permit for creating public trails and enhancements. The amended Ordinance was adopted to assist organized non-profit community groups to develop soft-surface, low impact bike/pedestrian/equestrian access for trail purposes within unopened county rights-of-way.

"Right of Way" is defined as all property in which the County has any form of ownership, interest or title, and which is held for the purpose of public roads and associated features such as, median, sidewalks, bicycle facilities, and public utilities. This definition applies regardless of whether or not any road exists thereon or whether or not it is used, improved, or maintained for public travel.           Kitsap County Road Standards

Kitsap County recognizes unopened rights-of-way as a potential asset in community trail planning. The original trail ordinance allowed pedestrian trail improvements within unopened rights-of-way, however, the improved trail ordinance specifies:

1.) Right of Way Permit Category 5 - guideline and procedures as relates directly to bike/pedestrian/equestrian trail improvements by community groups, clubs and organizations.

2.) Neighborhood trail improvements are good for the community and allows the Board of County Commissioners the latitude and discretion to waive fees associated with the application.

3.) Technical assistance to community groups by allowing the Department of Public Works to provide centerline field survey work as an in-kind contribution to the neighborhood effort.
