M I N U T E S KITSAP COUNTY BOARD OF COMMISSIONERS January 22, 2001 The Board of Commissioners met on the above-stated date. Present were Commissioner Tim Botkin, Commissioner Jan Angel, County Administrator Malcolm Fleming, Clerk of the Board, Holly Anderson and Deputy Clerk of the Board, Opal Robertson. (THE BOARD OF COMMISSIONERS' PUBLIC MEETINGS AND PUBLIC HEARINGS ARE AUDIO AND VIDEO TAPED). ITEMS SET FOR TIME CERTAIN: 10:00) Meeting Called to Order with Pledge of Allegiance. 10:00) Employee Service Awards recognition. Congratulations and Certificates of Appreciation were presented to the following County employees for their years of dedicated service to Kitsap County: Gordon Starnes, Department of Administrative Services; Peggy Bakalarski, Department of Community Development; Shelley Kneip, Prosecutor's Office; and Don Reffalt, Public Works Department. 10:00) A Public hearing to consider an application filed by Glen Gerber for Current Use Assessment Timberland Open Space on 18 acres located at 21801 Bond Road NE in North Kitsap County Commissioner District No. 1. Karanne Gonzalez, Department of Community Development, gave a brief overview of the County's Open Space Program and said this particular application was a transfer from Current Use Assessment Farm and Agriculture to Timberland. She said that the Planning Commission and staff had recommended conditional approval. Discussion was held between the Board and staff regarding buffers, the consistency of the open space requirements and that the open space program information was listed on the County's Web page under the Assessor's Office. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board concur with staff's recommendation thereby approving the application of Glen Gerber for Current Use Assessment-Timberland Open Space; further that an Order be executed so stipulating. Motion carried. 10:00) B Public hearing to consider an application filed by Glen Gerber for Current Use Assessment Open Space on 7.72 acres located at 21801 Bond Road NE in North Kitsap County Commissioner No. 1. Karanne Gonzalez, Department of Community Development, gave a brief overview of the application stating that this was a transfer from Current Use Assessment Farm and Agriculture to Open Space. She said that the Planning Commission and staff had recommended conditional approval. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board concur with staff's recommendation thereby approving the application of Glen Gerber for Current Use Assessment Open Space; further that an Order be executed so stipulating. Motion carried. 10:00) C Public hearing to consider an application filed by R. J. and Grace Brooks for Current Use Assessment Open Space on a1.07-acre parcel located at 14532 Sandy Hook Road NE in North Kitsap County Commissioner No. 1. Karanne Gonzalez, Department of Community Development, gave a brief overview of the application stating that the goal of the Brooks family was to maintain the property in a natural state and to provide wildlife habitat. She said that the Planning Commission and staff had recommended conditional approval. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board concur with staff's recommendation thereby approving the application of R. J. and Grace Brooks for Current Use Assessment Open Space; further that an Order be executed so stipulating. Motion carried. 10:00) D Public hearing to consider an application filed by Floyd and Lois Crum for Current Use Assessment Open Space on 14 acres located at 22991 Big Valley Road NE in North Kitsap County Commissioner No. 1. (Note: At the request of staff, this matter has been continued to February 5, 2001 at the hour of 10:00 AM). OTHER BUSINESS AND CONSENT ITEMS: 1) MISCELLANEOUS ITEMS: A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board: A. Approve Minutes of January 8, 2000. B. Approve Warrant Nos. 2903097 through 2904325 including manual warrant no. 2903096 in the amount of $3,038,164.74. C. Refer the following to the Prosecutor's Office and the Risk Manager: 1) Summons, Application for Writ of Certiorari and Complaint for Declaratory Judgment, Injunction and Amended Summons filed by the Suquamish Indian Tribe; 2) Summons, Complaint filed by Chehalem Mountain Nursery, Inc; and 3) Notice and Acknowledgment of Receipt of Complaint, Complaint for Damages filed by Alan Lujan and Marian Lujan. Motion carried unanimously. 2) DEPARTMENT OF AMINISTRATIVE SERVICES: A. A motion was made by Commissioner Botkin and seconded by Commissioner Angel that the Board adopt Resolution No. 014-2001* thereby transferring a Versa 2530 Laptop Computer from Information Services Division to Superior Court. Motion carried. B. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board adopt Resolution No. 015-2001* thereby reallocating appropriations within the 2000 General Fund budget. Motion carried. C. Discussion was held, comments a motion was made by Commissioner Botkin and seconded by Commissioner Angel that the Board approve and execute the contract between Kitsap County and Kitsap County Dispute Resolution Center (KC-007- 01) in the amount of $50,000 for dispute resolution and mediation services. Motion carried. D. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board adopt Resolution No. 016-2001* thereby establishing a petty cash fund for General Administration & Operations Board of Freeholders in the amount of $150. Motion carried. 3) CENTRAL COMMUNICATIONS DEPARTMENT: A. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board approve and execute the Intergovernmental Cooperative purchasing agreement between Kitsap County and Clallam County (KC-027-01) joining the Puget Sound LIDAR Consortium in order to take advantage of cost savings afforded the Consortium. Motion carried. 4) PERSONNEL& HUMAN SERVICES DEPARTMENT: A. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board approve and execute the contract between Kitsap County and The Department of Social & Health Services (KC-515-00) for the maximum consideration of $458,984 for the 2001 Older Americans Act Interagency agreement for the period of January 1, 2001 through December 31, 2001. Motion carried. B. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Botkin and seconded by Commissioner Angel that the Board adopt Resolution No. 017-2001* thereby reappointing John Poppe to the Kitsap County Sheriff's Civil Service Commission for a 6 year term, commencing January 22, 2001 and ending January 21, 2007. Motion carried. C. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board approve and execute the Collective Bargaining Agreement amendment between Kitsap County and Teamsters Local 589, Parks & Recreation (KC-411-99A) amending Article II, Section A-3 Insurance, Article II, Section G1 and Article II, Section G5, effective January 1, 2001. Motion carried. D. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board approve and execute the Memorandum of Understanding amendment between Kitsap County and WA State Council of County and City Employees, Local 1308 (KC-345-97B) amending Article II, Section E-Insurance, effective January 1, 2001. Motion carried. E. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board approve and execute the Collective Bargaining Agreement between Kitsap County and Teamsters Local 589, Parks & Recreation (KC-010- 01) for a 2 year contract, effective January 1, 2002 through December 31, 2003 providing for wage adjustments for 1/1/02 equivalent to 95% of the CPI-U. Motion carried. 5) PUBLIC WORKS DEPARTMENT: A. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board approve and execute the Interlocal agreement amendment between Kitsap County and Mason County (KC-449-99A) not to exceed $25,000/yr to provide moderate risk waste collection and disposal opportunities. Motion carried. B. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board approve and execute the contract amendment between Kitsap County and CH2M Hill Northwest, Inc (KC-023-00A) in the amount of $865,047 to provide professional services for the Bainbridge Island Landfill Project. Motion carried. C. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board approve and execute the contract amendment between Kitsap County and Prospect Construction (KC-555-99B) in the amount of $89,041.03 for construction work modifications to the Central Kitsap Wastewater Treatment Plant IIC Project. Motion carried. D. Resolution approving the Bicycle Facilities Plan and directing the County Engineer to further develop a plan, along with funding strategies and including specific improvement projects in future updates of the Six Year Transportation Improvement Program. (Note: THIS MATTER HAS BEEN CONTINUED TO FEBRUARY 5, 2001). E. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board approve and execute the Interlocal agreement between Kitsap County and Kitsap Public Utility District #1 (KC-494-00) in the amount of $3,000 to provide funding as co-sponsor for the Kitsap Water Festival. Motion carried. F. A motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board approve and execute the contract between Kitsap County and Entranco, Inc (KC-008-01) in the amount of $62,241 for design services for the Alaska Avenue Regional Stormwater Detention Facility. Motion carried. 6) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: (Please limit comments to 3 to 5 minutes) A. Donald Wilbur addressed the Board with concerns about the nuisance ordinance. B. Karl Jonietz thanked the Board for its financial support of the Economic Development Council and gave a brief overview of the council's goals. C. Zoltan Szigethy further addressed the Board with a synopsis of what was done by the Economic Development Council. D. Ron Ross apologized for photos submitted of a "junk property lot" supposedly owned by Kitsap County at a previous public hearing regarding the nuisance ordinance. He learned that the property did not belong Kitsap County. Ross also addressed the Board about having an updated map on the Internet depicting the true burn ban areas. He also asked that a redlined version of the changes to the nuisance ordinance be posted on the county's web page. E. Gene Ollenberger, Fred Rice and Earl Gallagher addressed the Board with concerns about the development of the Kitsap Mental Health Facilities housing project on Petersville Road. 7) COMMISSIONERS/ELECTED OFFICIALS/DEPARTMENT HEADS: A. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Angel and seconded by Commissioner Botkin that the Board adopt Resolution No. 018-2001* thereby appointing Lary Coppola to the Kitsap County Planning Commission representing South Kitsap for a term commencing January 1, 2001 and ending December 31, 2004.
