Present were Chair Tim Botkin, Commissioner Chris Endresen, Commissioner Jan Angel (not present), County Administrator Malcolm Fleming, Clerk of the Board, Holly Anderson and Deputy Clerk of the Board, Opal Robertson. ITEMS SET FOR TIME CERTAIN: 10:00) Meeting Called to Order with Pledge of Allegiance. 10:00) Recognition of participants who worked on the Kitsap County "Speak Out" forums. Chair Botkin gave a brief overview of the "Speak Out" forums and thanked all participants and agencies that worked to make these forums a success. Commissioner Endresen also thanked the North, Central and South Kitsap School Districts for hosting the forums. 10:00) A Presentation of Admissions Tax use for programs serving the Sexual Assault Center and Domestic Violence victims. Mary Ellen De la Pena, Personnel & Human Services, said for approximated 10 years the Board of Commissioners have directed Admissions Tax revenue to support services for survivors of domestic violence and sexual assault. De la Pena introduced Pamela Nickerson, Vice President of the Sexual Assault Center who gave a brief overview of the agency stating that it could not survive without the Admission Tax funds, United Way and CDBG funds that also came from the county as well as the City of Bremerton. She said fourteen years ago, the total budget for the agency was $17,000 and the current budget is $404,000. She said the agency treats sexually re-active children and served 2008 people on last year and of that amount 234 were children between the ages of 4 and twelve. She said the agency also helps the family of these children by providing trained therapists, advocates and other volunteers. Nickerson said the agency had good relationships with the school districts, the law enforcements agencies, and Harrison Hospital and Kitsap County Prosecutors office. 10:00) B Resolution proclaiming April 21-27, 2002 as Volunteer Recognition Week in Kitsap County. Jan Koske, Volunteer Coordinator, said each year dozens of dedicated citizens volunteer on County boards, commissions, committees and task forces and they represent a diversity of citizens living in Kitsap County. Koske said volunteers continue to contribute to the success of Kitsap County programs and services and that in 2001, at least 2,757 volunteers contributed 181,266 hours or more of services to Kitsap County. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 068-2002* thereby proclaiming April 21-27, 2002 as Volunteer Recognition Week in Kitsap County. Motion carried. 10:00) C Resolution proclaiming April 26- May 5, 2002 as National Dance Week in Kitsap County. Sharon Zerr, Acting Chair of Kitsap County Arts Board, gave a brief update of the Arts Board stating that it was in the midst of working on by-laws and guidelines for the Board and that this proclamation was its first official action. She asked the Board to approve the resolution. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 069-2002* thereby proclaiming April 26- May 5, 2002 as National Dance Week in Kitsap County. Motion carried. 10:00) D Public hearing to consider a Resolution adopting parking restrictions on Northlake Way NW and Seabeck Highway NW in Central Kitsap, District No. 3. Dusty Wiley, Public Works Department, said staff had received several complaints from residents who live in the area of the recently re-opened Horse and Cow Pub relative to the noise and traffic congestion along Northlake Way. He said there were also complaints about lack of walking area along the road, turn around for emergency vehicles, blocking driveways, blocking mailboxes and using residential properties for bathroom facilities. He said with the re-opening of the facility, it was required to put in a drain field which takes up approximately two-thirds of the parking lot resulting in the off street parking problem. Wiley said item #7 in the resolution dealt with motorcycle parking only in front of the building due to a requirement from the Fire Marshall's office and the poor visibility on entering and exiting the building. Chair Botkin said he realized there were other issues besides parking. He said the business is lawful at this point but inconsistent with the residential neighborhood. He stated that this hearing only deals with the parking and not any of the other issues. Erin Lambson addressed the Board with concerns about blocked driveways, emergency vehicles turn around and poor visibility from her driveway. Jeanette Keck agreed with comments made by Wiley and Lambson specifically about the poor visibility along the roadway. Robert Broussard had concerns about the traffic congestion and said he agreed with the comments made by Wiley. June Dechant agreed with what had been previously said but also had concerns about the access to her mailbox being often blocked on Friday nights. Pamela Salzwedel, mobile home park owner, said there is an individual who lives in the park who had been badly injured by a car approximately 3 years ago and has a real fear of that happening again. Salzwedel said the road was a real hazard and feared that someone might be eventually killed on that road. Larry Eyler agreed with the previous speakers but was concerned about emergency vehicle turn around on the road particularly on a Friday night. He was also concerned about patrons urinating on parked cars and doors being ripped off mailboxes. Steve Eyler agreed with his brother and said he supported the no parking restriction on Northlake Way. Pat Pardee felt this was a public safety issue of both body and property. He had concerns about the increase in car break-ins, residents having to walk in the streets due to vehicles parking along the roadway, obstructed driveways, lack of turn around for aid cars and lack of mail delivery due to blocked mail boxes. Discussion was held, comments called for and hearing no objection, a motion was made by Chair Botkin and seconded by Commissioner Endresen that the Board adopt Resolution No. 2002* thereby adopting parking restrictions on Northlake Way NW and Seabeck Highway NW in Central Kitsap. Motion carried. 10:00) E Closed Record Appeal to consider an appeal filed by Richard Best/Lemolo Citizens Club of the Hearing Examiner decision rendered December 6, 2001to deny the appeal of the Final Supplemental Environmental Impact Statement to the Final Environmental Impact Statement for the Central Kitsap County Wastewater Facilities Plan. On December 18, 2001, the appellants filed a timely Request for Reconsideration and on January 30, 2002 the Request for Reconsideration was also denied. PLEASE NOTE: This hearing has been postponed until further public notice to provide all parties involved the opportunity to work together to resolve some of the issues raised in the appeal. OTHER BUSINESS AND CONSENT ITEMS: 1) MISCELLANEOUS ITEMS: A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board: A. Approve Minutes of April 8, 2002. B. Approve Warrant Nos. 2987239 through 2988431 in the amount of $1,895,721.28. C. Refer to the Prosecutor's Office and the Risk Manager: 1) Claim for Damages filed by Ronald Schei. Motion carried. 2) DEPARTMENT OF COMMUNITY DEVELOPMENT: A. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board approve and execute the Memorandum of Agreement with The City of Poulsbo (KC-243-02) regarding jurisdiction permits review and construction of the Olhava Development Project. Net Fiscal Impact: $0 Source of Funds: N/A. Motion carried. 3) DEPARTMENT OF PERSONNEL AND HUMAN SERVICES: A. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board approve and execute the contract amendment Kitsap Community Resources (KC-168-02) to provide volunteer opportunities for school-age youth, particularly those at risk of becoming involved in the juvenile justice system for the period of January 1, 2002 through December 31, 2002. Net Fiscal Impact: $50,000. Source of Funds: County General Fund (Commission on Children & Youth). Motion carried. 4) DEPARTMENT OF PUBLIC WORKS: A. A motion was made by Commissioner Endresen and seconded by Chair that the Board adopt Resolution No. 071-2002* thereby authorizing improvements to Bethel-Burley Road SE for vehicle and pedestrian safety beginning at the intersection of SE Burley Olalla road to the Pierce County Line. Net Fiscal Impact: $35,000. Source of Funds: County Road Fund. Motion carried. B. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 072-2002* thereby authorizing improvements to SE Southworth Drive for vehicle and pedestrian safety beginning at the intersection of SE Olympiad Drive to SR 160. Net Fiscal Impact: $50,000. Source of Funds: Road Fund. Motion carried. C. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 073-2002* thereby authorizing improvements to NE Little Boston Road for vehicle and pedestrian safety beginning at the intersection of Hansville Road NE to the intersection of NE Cliffside Road. Net Fiscal Impact: $66,000. Source of Funds: County Road Fund. Motion carried. 5) JUVENILE SERVICES DIVISION: A. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board approve and execute the Interlocal agreement with Jefferson County (KC-178-02) to house Jefferson County youth in the Kitsap County Juvenile Detention Facilities. Net Fiscal Impact: 3 beds/day at a rate of $100/day whether occupied or not plus 2 additional beds at a rate of $100/day will be made available and reimbursed when occupied. Source of Funds: Jefferson County. Motion carried. 6) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: (Please limit comments to 3 to 5 minutes) A. Robert Brown addressed the Board with concerns about Short Subdivision #7201. 7) COMMISSIONERS/ELECTED OFFICIALS/DEPARTMENT HEADS: A. A motion was made by Commissioner Endresen and seconded by Commissioner Botkin that the Board approve and execute the Quit Claim Deed transferring Yaquina Avenue Property to the City of Bainbridge Island. Net Fiscal Impact: $0. Source of Funds: N/A. Motion carried. B. Recess to executive session on Monday, April 15, 2002 at the hour of 1:30 PM to discuss personnel and land acquisition issues. The executive session began at 1:30 PM and ended at 2:30 PM. Public Meeting Reconvened at 2:30 PM: C. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board exercise its option to purchase the Ravenholt property at Stavis Bay subject to a review appraisal for salmon habitat preservation. Net Fiscal Impact: $157,500 from grants funding and $52,500 from Conservation Futures. Source of Funds: 75% Salmon Recovery Funding Board and 25% Conservation Futures. Motion carried. 8) BOARD OF COMMISSIONER'S COMMENTS: A. Commissioner Endresen announced the Kingston Community Open House on Wednesday, April 24, 2002 at 7:00 PM at the Kingston Junior High School.
