M I N U T E S KITSAP COUNTY BOARD OF COMMISSIONERS May 15, 2000 The Board of Commissioners met on the above-stated date. Present were Chair Tim Botkin, Commissioner Chris Endresen, County Administrator Malcolm Fleming, Clerk of the Board, Holly Anderson and Deputy Clerk of the Board, Opal Robertson. ITEMS SET FOR TIME CERTAIN: 10:00) Meeting Called to Order with Pledge of Allegiance. 10:00) A Agency presentation by Helpline House and Martha & Mary Children's Services. Joanne Tews, Helpline House, gave a brief overview of this organization stating that it offered connection to the community with services that included information, transportation, crisis intervention, individual and family counseling, job and career counseling, clothing, food bank, community access for disabled seniors and volunteer opportunities. Joanna Carlson, Martha & Mary Children's Services, gave a brief overview and history of this organization stating that it had joined with Kitsap Community Resources Head Start Program in a partnership to offer a Head Start program and wrap around child-care services. She said the organization served 55 low-income families and that services also included food items for the children and an intergeneration program. 10:00) B Public hearing to consider an application filed by Annapolis Water District for a franchise for a period of twenty-five (25) years, to construct, operate and maintain water pipelines for a water system, in, under, along and over the public roads and highways in Kitsap County, Washington. Ron Yingling, Public Works Department, said that the original franchise was submitted to the County in 1962 for a period of 50 years and the applicant had applied to extend the franchise for an additional 25 years. He said that the franchise area was consistent with the service area of the Annapolis Water Comprehensive Plan and believed that the franchise was up to date and in order. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board approve the franchise application filed by Annapolis Water District. Motion carried. OTHER BUSINESS AND CONSENT ITEMS: 1) MISCELLANEOUS ITEMS: A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board: A. Approve Minutes of May 8, 2000. B. Approve Warrant Nos. 2860408 through 2861611 including manual warrant nos. 2860407 in the amount of $1,541,303.88. C. Adopt Resolution No. 089-2000* thereby setting date of public hearing for June 5, 2000 at the hour of 10:00 AM to consider a Supplemental Appropriation increasing the budget of the General Fund in the amount of $38,252 in order to comply with a contract with the City of Port Orchard for legal services. D. Set date of public hearing for June 5, 2000 at the hour of 10:00 AM to consider amending Ordinance No. 59, Gambling Tax Ordinance, amending the tax exemption amount for raffles, punch boards and pull-tabs conducted by bona fide charitable or non-profit organizations and to lower the tax imposed on bingo and raffles to reflect changes in state law. E. Set date of public hearing for June 5, 2000 at the hour of 10:00 AM to consider amending Ordinance No. 150-1993, Timber Harvest Ordinance, Section 7, Standards; Section 18, Process for Lifting of Permit Moratoria; Section 19, Enforcement and Section 18, Providing a process for lifting a Forest Practices Six- Year Moratoria, Criteria and Performance requirements. F. Continuation of a joint public hearing to June 5, 2000 at the hour of 5:30 PM, in the Bremerton City Council Chambers, 239 Fourth Street, Bremerton, Washington, between the Kitsap County Board of Commissioners and the Bremerton City Council to consider the 'Kitsap County Sub-Area Plan – Port Blakely Joint Planning Area' including the necessary amendments to each jurisdictions Comprehensive Plan and implementing development regulations. Motion carried. 2) DEPARTMENT OF ADMINISTRATIVE SERVICES: A. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 090-2000* thereby establishing a Deputy Prosecutor's position in the Prosecutor's Office. Motion carried. 3) DEPARTMENT OF PUBLIC WORKS: A. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board approve and execute the contract between Kitsap County and Ace Paving Company (KC-209-00) in the amount of $419,837.88 for the widening and realignment of 1.27 miles of Carney Lake Road SE in South Kitsap County. Motion carried. B. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 091-2000* thereby authorizing closure of Nels Nelson Road between Raven Creek Drive and NW Creekside Lane to all vehicular traffic except authorized and emergency vehicles from 7:00 AM, June 12, 2000 until 5:00 PM, August 14, during the installation of culvert under the roadway. Motion carried. C. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 092-2000* thereby transferring a Road Division Sander, valued at $9,000 into the Public Works Department, Road Division ER&R Fund Account as contributed capital without a transfer of funds. Motion carried. 4) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: (Please limit comments to 3 to 5 minutes) A. Vivian Henderson, Kitsap Association of Realtors, addressed the Board with environmental concerns and meetings held between County staff and the National Marine Fisheries Service. 5) COMMISSIONERS/ELECTED OFFICIALS/DEPARTMENT HEADS: A. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 093-2000* thereby creating a Public Facilities District and providing for appointment of members to the district. Motion carried. B. Assessor's Office Budget presentation. Jim Avery, Kitsap County Assessor, gave a slide presentation and brief overview of his departmental budget. C. Recess to Executive Session to discuss litigation and land acquisition immediately following the public meeting. The executive session began at 11:30 PM and ended at 12:00 Noon. D. Recess to Executive Session on Tuesday, May 16, 2000 at the hour of 3:00 PM to discuss personnel issues. The executive session began at 3:00 PM and ended at 4:00 PM. Public hearing adjourned.
