M I N U T E S KITSAP COUNTY BOARD OF COMMISSIONERS June 5, 2000 The Board of Commissioners met on the above-stated date. Present were Chair Tim Botkin, Commissioner Chris Endresen, Commissioner Charlotte Garrido, Clerk of the Board, Holly Anderson and Deputy Clerk of the Board, Opal Robertson. ITEMS SET FOR TIME CERTAIN: 10:00) Meeting Called to Order with Pledge of Allegiance. 10:00) Recognition of "Employee of the Month", June, 2000. Congratulations and a Certificate of Appreciation was presented to Jan Koske, Volunteer Coordinator, on being selected "Employee of the Month". During 1999, the County benefited from the efforts of over 1,700 volunteers who donated over 148,000 hours of their time to County Services. Koske has developed volunteer handbooks for both the volunteers and staff and provides on-going assistance and support to volunteers and departments. 10:00) A Presentation by the Tracyton Soccer Club. Larry Cote, Park & Recreation Department, introduced Tom Marcucci, Tracyton Soccer Club, who presented a check to the County in the amount of $8600 to help with renovation/installation of a sub-surface drainage system at the multi-use Gordon Field. 10:00) B Public hearing to consider a Supplemental Appropriation increasing the budget of the General Fund in the amount of $38,252 in order to comply with a contract with the City of Port Orchard for legal services. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve the supplemental appropriation in the amount of $38,252; further that an Order be executed so stipulating. Motion carried unanimously. Karl Duff questioned whether this supplemental was an emergency requirement or an existing annual service and if it was, why wasn't it included in the basic County budget. Commissioner Garrido explained that this was an agreement with the City of Port Orchard to provide their Prosecuting Attorney's Office with services similar to what had been provided to the other cities and that this matter had just emerged and that funding came from the City of Port Orchard. 10:00) C Public hearing to consider amending Ordinance No. 59, Gambling Tax Ordinance, amending the tax exemption amount for raffles, punch boards and pull-tabs conducted by bona fide charitable or non-profit organizations and to lower the tax imposed on bingo and raffles to reflect changes in state law. Kathryn Portteus, Prosecutor's Office, said that these were administrative changes to the Gambling Ordinance in order to bring it into compliance with State law and that there would be no economic affect on the County nor would it have any affect on the purveyors of gambling. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and enact Ordinance No. 59-D-2000** thereby amending the tax exemption amount for raffles, punch boards and pull-tabs conducted by bona fide charitable or non-profit organizations and to lower the tax imposed on bingo and raffles to reflect changes in state law. Motion carried unanimously. 10:00) D Public hearing to consider amending Ordinance No. 150-1993, Timber Harvest Ordinance, Section 7, Standards; Section 18, Process for Lifting of Permit Moratoria; Section 19, Enforcement and Section 18, Providing a process for lifting a Forest Practices Six-Year Moratoria, Criteria and Performance requirements. Karanne Gonzalez, Department of Community Development, said that on request by the Board, staff had drafted an amendment to the existing Timber Harvest Ordinance and that they were in keeping with changes to the Forest Practice Act that made the six-year development moratoria automatic. She said that prior to, the statute allowed but did not require multiple jurisdictions to impose the moratorium. Gonzalez said that there were some housekeeping/cleanup of the ordinance in Section 7, Standards and Section 19, Enforcement and that the Planning Commission had recommended approval of the draft ordinance on April 4, 2000. Discussion was held between the Board and staff regarding critical areas buffer definition, danger tree definition, essential public facilities, location/permitting of cell towers, addition of a criteria section for lifting of a moratorium, performance standards, buffer requirements, whether the property owner notification radius was adequate, the enforcement ordinance, buffer requirements other than critical areas, a need for consistency for defining essential public facilities in all county regulations and why the reference to the comprehensive plan regarding essential public facilities was deleted from the ordinance. Gary Chrey, Waste Management of Washington, suggested that any standards or changes to the ordinance should be clear and that the private sector must have certainty and predictability when dealing with ordinances. He also complimented Gonzalez on the good work that had been done on this ordinance process. Bill Arness addressed the Board with concerns about the issuance of a timber harvest permit from both the county and DNR, possibly including the definition of public resources under essential public facilities, clearer definition of 30% in Section 11 (g), renewal process for a timber harvest permit, set standard on notification radius and the effect on environment after lifting a moratorium. Scott Hendon suggested that essential public facilities should include all schools and not just public schools. Chair Botkin said that the Board would receive written comments on this matter until the close of business on Monday, June 12, 2000. A motion was made by Chair Botkin and seconded by Commissioner Endresen that the Board continue this matter to June 19, 2000. Motion carried unanimously. 5:30) Continuation of a joint public hearing between the Kitsap County Board of Commissioners and the Bremerton City Council held in the Bremerton City Council Chambers, 239 Fourth Street, Bremerton, Washington, to consider the 'Kitsap County Sub- Area Plan – Port Blakely Joint Planning Area' including the necessary amendments to each jurisdictions Comprehensive Plan and implementing development regulations. (PLEASE NOTE: THIS MATTER HAS BEEN RESCHEDULED TO JUNE 26, 2000 AT THE HOUR OF 5:30 PM). OTHER BUSINESS AND CONSENT ITEMS: 1) MISCELLANEOUS ITEMS: A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board: A. Approve Minutes of May 22, 2000. B. Approve Warrant Nos. 2862847 through 2864048 including manual warrant nos. 2862844 through 2862846 in the amount of $1,803,840.26 and warrant nos.2864050 through 2865328 including manual warrant no. 2864049 in the amount of $4,052,587.01. C. Set date of public hearing for June 19, 2000 at the hour of 10:00 AM to consider an Ordinance establishing policies and procedures for Kitsap County Right-of-Way Vacations and Tax Title Strip sales. D. Refer the following to the Prosecutor's Office and the Risk Manager: 1) Summons, Complaint for Damages filed by James Kim Leland; and 2) Note for Motion Docket, Posten's Motion to Strike, Order Granting Posten's Motion to Strike State of Washington's Response Brief-1/2 [Proposed] and Notice of Availability for Posten's Motion to Strike filed by Manke Lumber Company, et al. E. Set date of public hearing for June 19, 2000 at the hour of 10:00 AM to consider oral and written comments regarding the Second Draft, Kitsap County Open Space Plan. An adoption hearing will follow immediately after the public hearing. The Open Space Plan is a six-year plan for the County Parks Department that outlines the County's acquisition and development objectives for park, recreation and open space facilities. F. Adopt Resolution No. 098-2000* thereby setting date of public hearing for June 19, 2000 at the hour of 10:00 AM to consider a rate change requested by AT&T Cable Services. G. Set date of public hearing for June 26, 2000 at the hour of 10:00 AM to consider an application filed by Sunnyslope Water District for a franchise for a period of twenty-five (25) years, to construct, operate and maintain water pipelines for a water system, in, under, along and over the public roads and highways in Kitsap County, Washington. H. Set date of public hearing for June 26, 2000 at the hour of 10:00 AM to consider an application filed by North Perry Avenue Water District for a franchise for a period of twenty-five (25) years, to construct, operate and maintain water pipelines for a water system, in, under, along and over the public roads and highways in Kitsap County, Washington. I. Set date of public hearing for June 19, 2000 at the hour of 10:00 AM to consider a petition to establish the following area as an area in which the discharge of firearms is prohibited: Bandix Road from county line north to Burley-Olalla Road, then west to Bethel-Burley Road, then south to the county line, then east to Bandix; and a proposed ordinance amending Kitsap County Code Section 10.24.090 (Discharge of firearms—Areas where prohibited) to reflect the establishment of this no-shooting area. The full text of the proposed resolution and ordinance will be mailed upon request to the Clerk of the Board. Motion carried unanimously. 2) DEPARTMENT OF PERSONNEL & HUMAN SERVICES: A. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract amendment between Kitsap County and Washington State Employment Security (KC-493-98A) adding the amount of $743,390 for a new total of $1,549,301, increasing the participant level to 277 and extending the contract end date to December 31, 2001 for the Welfare-to-Work Program. Motion carried unanimously. B. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract between Kitsap County and Kitsap Mental Health Services (KC-214-00) in the amount of $36,552.75 to provide catered meals to Kitsap Mental Health Services adult and adolescent treatment units. Motion carried unanimously. C. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board adopt Resolution No. 099- 2000* thereby appointing Mary F. Annese to serve on the Kitsap County Commission on Children & Youth for a 3-year term commencing June 5, 2000 and ending June 4, 2003. Motion carried unanimously. D. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract amendment between Kitsap County, Kitsap County Superior Court and The Office & Professional Employees International Union, Local 11, AFL-CIO (KC-237-99A) modifying Article 14, Health and Welfare Benefits, Page 12, effective February 1, 2000 and that all other terms and conditions of the original contract remain in full force and effect. Motion carried unanimously. E. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract amendment between Kitsap County, Kitsap County Superior Court and The Office & Professional Employees International Union, Local 11, AFL-CIO (KC-237-99B) 1) revising Article 8.3.2 to define the work week; 2) establishing the seniority ranking for employees hired as Juvenile Detention Officers on May 26, 1998; 3) and that all other terms and conditions of the original contract remain in full force and effect. Motion carried unanimously. F. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board adopt Resolution No. 100-2000* thereby reclassifying positions within the Department of Public Works. Motion carried unanimously. 3) PROSECUTOR'S OFFICE: A. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract amendment between Kitsap County and The Alan B. Hughes Law Firm (KC-448-98A) to extend the term of the contract to June 30, 2001 for legal services. Motion carried unanimously. B. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract amendment between Kitsap County and The Buck & Gordon Law Firm (KC-230-99A) to extend the term of the contract to April 25, 2002 for legal services. Motion carried unanimously. C. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board Contract between Kitsap County and Yarmuth, Wilsdon, Calfo Law Office (KC-248-00) in the amount of $30,000 for legal services regarding county solid waste issues in connection with the proposed Transfer Station Development and Waste Disposal Project. Motion carried unanimously. 4) DEPARTMENT OF CENTRAL COMMUNICATIONS: A. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract between Kitsap County and Washington Explorer Search & Rescue (KC-186-00) regarding an agreement for operation of a coordination/communications vehicle for the purpose of assisting the County and State in these operations and activities. Motion carried unanimously. 5) DEPARTMENT OF PARKS & RECREATION: A. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board adopt Resolution No. 101-2000* thereby authorizing the Department of Parks and Recreation to apply for matching grants with the Department of Natural Resources. Motion carried unanimously. 6) DEPARTMENT OF PUBLIC WORKS: A. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract amendment between Kitsap County and Philip Service Corporation (KC-336-99A) in the amount of $220,000 for moderate risk waste transportation and management services and extending the contract period for an additional year commencing April 1, 2000 through April 1, 2001. Motion carried unanimously. B. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract between Kitsap County and Ace Paving Company (KC-230-00) in the amount of $274,095.60 for improvements to the Silverdale vicinity asphalt overlay. Motion carried unanimously. C. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract between Kitsap County and SCA Engineering (KC-250-00) in the amount of $60,000 for pre-design/environmental studies for the Clear Creek Trail; for Chair's signature. Motion carried unanimously. D. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board adopt Resolution No. 102-2000* thereby authorizing the sale of one 1987 International dump truck to the Annapolis Water District in the amount of $20,000 with proceeds of sale credited to the Kitsap County Public Works Department's ER&R Fund Account. Motion carried unanimously. 7) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: (Please limit comments to 3 to 5 minutes) 8) COMMISSIONERS/ELECTED OFFICIALS/DEPARTMENT HEADS: A. Louise Turner, WSU Cooperative Extension, introduced Arno Bergstrom, Cooperative Extension's new agent. B. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board adopt Resolution No. 103-2000* thereby incorporating existing policies into a Kitsap County Manual. Motion carried unanimously. C. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract between Kitsap County and Triangle Associates Inc (KC-237-00) in the amount of $37,455.90 for Phase I services for the Water Resource Inventory Area (WRIA 15) Watershed Management Planning Process. Motion carried unanimously. D. Recess to an executive session on Monday, June 5, 2000 at the hour of 1:45 PM to discuss personnel issues. The executive session began at 1:45 PM and ended at 2:00 PM.
