M I N U T E S KITSAP COUNTY BOARD OF COMMISSIONERS June 26, 2000 The Board of Commissioners met on the above-stated date. Present were Chair Tim Botkin, Commissioner Chris Endresen, Commissioner Charlotte Garrido, County Administrator, Malcolm Fleming, Clerk of the Board, Holly Anderson and Deputy Clerk of the Board, Opal Robertson. ITEMS SET FOR TIME CERTAIN: 10:00) Meeting Called to Order with Pledge of Allegiance. 10:00) Employee Service Awards. Congratulations and Certificates of Appreciation were presented to the following County Employees for their many years of service to Kitsap County: Robert McGinley, Assessor's Office; Dana Hills, Commissioner's Office; Robert Schlotte, Parks & Recreation Department; Roberta Bunker and Celeste Griffin, Personnel & Human Services; Patrick Reeves, Public Works Department and Stephen Huggins, Sheriff's Office. 10:00) A Public hearing to consider an application filed by Sunnyslope Water District for a franchise for a period of twenty-five (25) years, to construct, operate and maintain water pipelines for a water system, in, under, along and over the public roads and highways in Kitsap County, Washington. Ron Yingling, Public Works Department, gave a brief overview of the water district franchises and said that staff was updating the applications to reflect boundary changes and legal descriptions. Discussion was held, comments called for and hearing no objection, a motion made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve the franchise application filed by the Sunnyslope Water District. Motion carried unanimously. 10:00) B Public hearing to consider an application filed by North Perry Avenue Water District for a franchise for a period of twenty-five (25) years, to construct, operate and maintain water pipelines for a water system, in, under, along and over the public roads and highways in Kitsap County, Washington. Discussion was held, comments called for and hearing no objection, a motion made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve the approve the franchise application filed by the North Perry Avenue Water District. Motion carried unanimously. 10:00) C Public hearing to consider an appeal filed by Earl Gallagher, et al of the Hearing Examiner's decision to approve with conditions the application of The Kitsap County Consolidated Housing Authority for a Conditional Use Permit to construct and operate multi-family, low income housing for Kitsap Mental Health Services clients. The proposed project site is located at 4010 Petersville Road in Central Kitsap, Commissioner District No. 3. Chair Botkin explained that this was a closed record appeal hearing that meant that a previous hearing had been conducted before the Hearing Examiner in which public testimony on this matter had already been given. He said that after the decision from the Hearing Examiner, three specific items had been appealed, that the Board would only consider those three specific issues and that each side had ten minutes to present its case. Dave Mitchell, appellant, believed that there was contradiction in the Hearing Examiner's decision and asked for clarification relative to tenancy being beyond his jurisdiction because during the previous hearing there were decisions made based on the tenancy of the building. Mitchell also addressed the Board with concerns about the requirement for public health, safety and general welfare including sidewalks, other planning features and funding requirements for this project being designated for low income, mental health individuals for fifty years. He said that the Hearing Examiner's decision did not address potential safety impacts nor did it address what would happen if the nature of the proposed tenants changed, the intent of sidewalks were vague and questioned their implementation. Mitchell did not believe that this project met the County's comprehensive land use policies and that the immediate area already had a large percentage of low-income density housing and that this project would change the proposed character of the immediate neighborhood. Darryl Piercy, Department Community Development, said that this application had been viewed by the Hearing Examiner as a multi-family housing unit located within the Petersville Road neighborhood. He said that the Hearing Examiner had viewed this application as a land use matter and that his jurisdictional authority was limited to those issues pertaining strictly to land use and not to the tenancy of the structure. Relative to sidewalks and other improvements, Piercy said that it was the applicant's responsibility to provide safe travel from this facility to surrounding areas and that a transit stop would be relocated directly in front of the facility. He said that the only other requirement that could be imposed on the applicant could be a sidewalk along the frontage of the project but doing so at this time would not enhance pedestrian safety for the tenants. He said that relative to Condition (L), site distance, there was a typographical error in the Hearing Examiner's decision and that instead of referencing site distance onto Harris Road, it should reference Petersville Road. Discussion was held between the Board and staff relative to the respective tenants, copy of the Hearing Examiner's audio tape previous hearing, tenancy of the building, transportation needs, information on the Sussex County court case referenced in the Board's packet and the process for appeal hearing. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board continue matter for decision only to July 17, 2000. Motion carried unanimously. 10:00) D Continuation of a public hearing to consider enacting an Ordinance establishing policies and procedures for Kitsap County Right-of-Way Vacations and Tax Title Strip sales. (NOTE: AT REQUEST OF STAFF, THIS MATTER HAS BEEN CONTINUED TO JULY 3, 2000). 5:30) Continuation of a joint public hearing between the Kitsap County Board of Commissioners and the Bremerton City Council held in the Bremerton City Council Chambers, 239 Fourth Street, Bremerton, Washington, to consider the 'Kitsap County Sub- Area Plan – Port Blakely Joint Planning Area' including the necessary amendments to each jurisdictions Comprehensive Plan and implementing development regulations. (NOTE: AT THE REQUEST OF APPLICANT, THIS MATTER HAS BEEN CANCELLED AND HAS NOT BEEN RESCHEDULED). OTHER BUSINESS AND CONSENT ITEMS: 1) MISCELLANEOUS ITEMS: A motion was made by Commissioner Garrido and seconded by Commissioner Endresen the Board: A. Approve Minutes of June 19, 2000. B. Approve Warrant Nos. 2867686 through 2868895 including manual no. 2867685 in the amount of $3,256,106.95. C. Refer the following to the Prosecutor's Office and the Risk Manager: 1) Claim for Damages filed by Richard Lecher and 2) Posten's Reply to county and State Response Briefs filed by Manke Lumber Company. D. Adopt Resolution No. 117-2000* thereby setting date of public hearing for July 17, 2000 at the hour of 10:00 AM to consider a Supplemental Appropriation increasing the budget of the K-PREP Fund in the amount of $139,000 in order to accept a FEMA Project Impact Grant. E. Adopt Resolution No. 118-2000* thereby setting date of public hearing for July 17, 2000 at the hour of 10:00 AM to consider a Supplemental Appropriation increasing the budget of the General Fund in the amount of $218,476 in order to appropriate both the revenue and expenditures to add four deputies to the Sheriff's Department. F. Set date of public hearing for July 17, 2000 at the hour of 10:00 AM to consider an application filed by Manchester Water District for a franchise for a period of twenty-five (25) years, to construct, operate and maintain water pipelines for a water system, in, under, along and over the public roads and highways in Kitsap County, Washington. G. Set date of public hearing for July 10, 2000 at the hour of 10:00 AM to consider a petition filed by James Chumbly to sell at public auction two (2) tax-title properties near South Kingston Road in Kingston, Commissioner District No. 1. Motion carried unanimously. 2) DEPARTMENT OF COMMUNITY DEVELOPMENT: A. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract between Kitsap County and Stephen Causseaux (KC-276-00) in the amount of $5,000 per month for Hearing Examiner services for the period of July 1, 2000 through June 30, 2004. Motion carried unanimously. 3) DEPARTMENT OF CENTRAL COMMUNICATIONS: A. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract between Kitsap County and Radio Mobile Systems Incorporated (KC-287-00) in the amount of $102,225 + WSST for the purchase of Mobile Data Systems products. Motion carried unanimously. 4) DEPARTMENT OF PERSONNEL & HUMAN SERVICES: A. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract amendment between Kitsap County and Operating Engineers, Local 302, Teamsters, Local 589, IAM &AW, District 160, Local 282 and Laborers Union, Local 252 (KC-413-97A) for the establishment of a new classification and wage grade assignment within the IAM & AW, District 160, Local 282 Bargaining Unit, effective June 1, 2000. Motion carried unanimously. B. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board adopt Resolution No. 119-2000* thereby reclassifying a position within the Personnel & Human Services Department. Motion carried unanimously. C. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract between Kitsap County and Catholic Community Services (KC-265-00) for the maximum consideration of $200,000 for the Chore Personal Care Services for the period of July 1, 2000 through June 30, 2001. Motion carried unanimously. D. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract between Kitsap County and Catholic Community Services (KC-268-00) for the maximum consideration of $2,700,500 for Medicaid/COPES Personal Care Services for the period of July 1, 2000 through June 30, 2001. Motion carried unanimously. E. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the contract between Kitsap County and Kitsap Home Care (KC-266-00) for the maximum consideration of $425,000 for Medicaid/COPES Personal Care Services for the period of July 1, 2000 through June 30, 2001. Motion carried unanimously. 5) DEPARTMENT OF PUBLIC WORKS: A. Discussion was held, comments called for and hearing no objection, a motion made by Chair Botkin and seconded by Commissioner Endresen that the Board adopt Resolution No. 120-2000* thereby authorizing the closure of various county roads during the annual festival known as "Whaling Days" on July 28, 29, and 30, 2000. Motion carried unanimously. B. Discussion was held, comments called for and hearing no objection, a motion made by Commissioner Garrido and seconded by Commissioner Endresen that the Board adopt Resolution No. 121-2000* thereby establishing a restricted "no parking zone" on the north side of Thorson Road West starting at Division Avenue West and continuing east for 265 feet in Central Kitsap, Commissioner District No 3. Motion carried unanimously. 6) SHERIFF'S DEPARTMENT: A. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Commissioner Garrido that a the Board approve and execute the Interlocal agreement between Kitsap County and Mason County, Cities of Bainbridge Island, Port Orchard, Bremerton, Poulsbo, Shelton and The Washington State Patrol to provide for and regulate the joint efforts of City, County and State law enforcement to combat violations of controlled substance laws within the contracting jurisdiction for their mutual advantage. Motion carried unanimously. 7) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: (Please limit comments to 3 to 5 minutes) A. Vivian Henderson, Kitsap County Association of Realtors read a letter to the Board relative to the Port Blakely Project. 8) COMMISSIONERS/ELECTED OFFICIALS/DEPARTMENT HEADS: A. Recess to executive session on Monday, June 26, 2000 at the hour of 11:30 AM to discuss land acquisition. The executive session began at 11:30 AM and ended at 11:40 AM. B. Discussion was held, comments called for and hearing no objection, a motion was made by Chair Botkin and seconded by Commissioner Garrido that the Board adopt Resolution No. 122-2000* thereby granting authority to the Prosecuting Attorney or his deputy to purchase real property in the amount of $661.000 or the higher appraised amount. Motion carried unanimously. C. Commissioner Endresen said that she had met with a representative from Port Blakely and they were working on a new schedule for the Port Blakely project. D. Commissioner Garrido announced that she had attended Historic Homes walking tour. Public meeting adjourned.
