M I N U T E S KITSAP COUNTY BOARD OF COMMISSIONERS AUGUST 21, 2000 The Board of Commissioners met on the above-stated date. Present were Chair Tim Botkin, Commissioner Chris Endresen, Commissioner Charlotte Garrido, County Administrator, Malcolm Fleming, Acting Clerk of the Board, Rosalie Sadler and Deputy Clerk of the Board, Opal Robertson. ITEMS SET FOR TIME CERTAIN: 10:00) Meeting Called to Order with Pledge of Allegiance. 10:00) Department of Ecology presentation (Central Kitsap & Manchester Treatment Plant). Rick Gagnon, Department of Public Works introduced John Glenn of the Department of Ecology who presented congratulations and "Outstanding Wastewater Treatment Plant Awards" to the Central Kitsap and Manchester Treatment plants for being in 100% compliance with their discharge permits in 1999. Don Johnson, Manchester Plant and John Gardner, Central Kitsap Plant accepted the awards on behalf of staff. 10:00) A Continuation of a public hearing to consider amending Kitsap County Ordinance No. 127-1997 as is amended in Ordinance No. 127A-1999 relating to animal control and increasing fees and penalties and adopt a Resolution appointing a work study group. Malcolm Fleming, County Administrator, said that various changes to the ordinance had been recommended and that a work-study group was been established for additional work on the ordinance and recommendations to the Board. Donna Reinhart, Save or Pets, said that she would like to serve on the work-study group. Discussion was held, comments called for and hearing no objection a motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board adopt Resolution No. 151-2000* thereby establishing a work-study group and appointing members to that group for additional review and recommendation to the Board of Commissioners relative to animal control, fee increases and penalties. Motion carried unanimously. 10:00) B Continuation of a public hearing to consider the Policies and Procedures for the Kitsap County Right-of-way Vacations and Disposition of County-owned Land Ordinance. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board continue this matter to August 28, 2000. Motion carried unanimously. 10:00) C Public hearing to consider adoption of the Bethel Road Corridor Plan and amend the Kitsap County Zoning Ordinance to include the Land Use Element from the Corridor Development Plan. Darryl Piercy, Department of Community Development, said that this project represented over a year of community-based work on various topics associated with the project. He said that it involved two county departments working together and that the ideas were derived from the citizens in the area. He said that there were consistently between 20 and 30 individuals who attended the workshops and meetings and that the numbers increased at the end. He said that the county was working under a limited budget and that everyone was not be able to get everything that they wanted. Piercy believed that the plan would be beneficial to the community and that staff was pleased with the effort. He said that the land use element of the plan had been before the Planning Commission and had been approved. Discussion was held between the Board and staff regarding the definition of highway tourist commercial. Vivian Henderson, Washington Association of Realtors, complimented the county staff on the work done on this plan and said that she was amazed at the number of individuals who participated on the plan. She urged the Board to adopt this plan. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board enact Ordinance No. 247-2000** thereby approving the Bethel Road Corridor Plan subject to minor changes recommended by Commissioner Endresen. Motion carried unanimously. 10:00) D Continuation of a public hearing for decision only to consider a closed record appeal filed by Chris Plummer, Louise Lien and Myron P. Erickson of the Hearing Examiner's decision to approve subject to conditions a Conditional Use Permit for construction of a 5,418 square-foot satellite fire station with five sleeping quarters, three apparatus bays, associated parking, landscaping, pump station, sewage treatment and storm water facility located on South Kingston Road, west of Tulin Road and directly adjacent to and west of PUD #1 water tower in North Kitsap County, Commissioner District No. 1. Commissioner Endresen said that this was a closed record appeal and that the Board of Commissioners, sitting as an appellant body must determine from the record that the Hearing Examiner made an error and that the Board could not consider any issues that were not a part of the original hearing held before the Hearing Examiner. She believed that the Hearing Examiner addressed the safety issues via Conclusions B: 8, 9, and 11. Commissioner Endresen also said that she understood the residents concerns and agreed that this was not the "ideal" site, however, in this area of Kingston/Indianola, narrow, tree lined, curved roads were prevalent. She said that emergency services were still needed, that this was a small sub-station and was needed for the health, safety and welfare of the residents. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board concur with the Hearing Examiner thereby approving subject to the conditions the Conditional Use Permit and denying the appeal filed on this matter. Motion carried unanimously. OTHER BUSINESS AND CONSENT ITEMS: 1) MISCELLANEOUS ITEMS: A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board: A. Approve Minutes of August 14, 2000. B. Approve Warrant Nos. 2877023 through 2878491 including manual warrant no. 2877022 in the amount of $3,529,952.54. Motion carried unanimously. 2) SHERIFF'S OFFICE: A. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Collective Bargaining agreement between Kitsap County and Washington State Council of County & City Employees, AFSCME, AFL-CIO (KC-404-00) for a (3) year contract with the Corrections Officers, effective January 1, 2000 through December 31, 2002. Motion carried unanimously. 3) DEPARTMENT OF PERSONNEL & HUMAN SERVICES: A. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Contract between Kitsap County and Washington State Employment Security Department (KC-383-00) in the amount of $856,826 for the Workforce Investment Act (WIA) Adult program for the period of July 1, 2000 through June 30, 2002. Motion carried unanimously. B. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Contract between Kitsap County and Washington State Employment Security Department (KC-382-00) in the amount of $856,809 for the Workforce Investment Act (WIA) Dislocated Workers program for the period of July 1, 2000 through June 30, 2002. Motion carried unanimously. C. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Contract between Kitsap County and Washington State Employment Security Department (KC-376-00) in the amount of $117,075 for the Welfare to Work (Community Action Agencies/Community-Based Organizations) for the period of July 1, 2000 through June 30, 2002. Motion carried unanimously. D. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Interlocal agreement between Kitsap County and DSHS (KC-412-00) for a total consideration of $1,015,144 for Federal Funded services for the period of July 1, 2000 though September 30, 2000. Motion carried unanimously. E. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Interlocal agreement between Kitsap County and DSHS (KC-411-00) for a total consideration of $395,077 for Federal Funded services for the period of July 1, 2000 though June 30, 2001. Motion carried unanimously. F. Resolution adopting the Kitsap County Personnel Manual as revised. (THIS MATTER WAS CONTINUED TO SEPTEMBER 11, 2000). John Vodopich, Department of Community Development, asked that if the Board did have additional work-study sessions on this matter, all employees should be notified. Rick Kimball, Department of Community Development, addressed the Board with concerns about "at-will" employees, administrative leave and the county being able to attract and retain qualified employees. Meg Sands, Department of Community Development, addressed the Board with concerns about attendance and absenteeism. Jacqueline Aufderfheide, Prosecutor's Office, addressed the Board with concerns about what the each elected official was responsible for as it related to their specific departments. G. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board adopt Resolution No. 152-2000* thereby creating a position within the Parks and Recreation Department. Motion carried unanimously. 4) PUBLIC WORKS DEPARTMENT: A. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the contract between Kitsap County and Ace Paving Company (KC-389-00) in the amount of $754,046.96 for construction of a 0.41 mile extension of Lindvog Road NE from NE West Kingston Road to Milepost 0.10. Motion carried unanimously. B. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board adopt Resolution No. 153-2000* thereby authorizing closure of Fairgrounds Road from 6:00 A.M. August 22, 2000 until 10:00 P.M. August 27, 2000 due to the Kitsap County Annual Fair and Rodeo. Motion carried unanimously. 5) PARKS AND RECREATION DEPARTMENT: A. Purchase and Sale Agreement between Kitsap County Vern Knight and Judy Buffington (KC-425-00) in the amount of $351,450 for the acquisition of Three Springs property. (THIS MATTER WAS CONTINUED TO AUGUST 28, 2000). 6) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: (Please limit comments to 3 to 5 minutes) A. Mary Bertrand, Chums of Barker Creek, thanked the Board for its environmental commitment to Kitsap County. B. Vivian Henderson, Washington Association of Realtors, addressed the Board with concerns about the price appraisal for the Three Springs property. C. Roy Crocky addressed the Board with concerns about the "burned out" property that was located next to his and asked if there was a way to speed up the abatement process. D. Andrea MacDonald, Washington Cemetery Association, addressed the Board with concerns about identifying all cemeteries in the county and not issuing building permits for those areas. 7) COMMISSIONERS/ELECTED OFFICIALS/DEPARTMENT HEADS: A. Commissioner Garrido presented a Certificate to Marty Kellogg, Olalla Community Club in support of the Ninth Annual Olalla Summer Bluegrass Festival. She also reminded the public that the Kitsap County Fair & Rodeo would began this week. Public meeting adjourned. AUGUST 29, 2000: 5:30 PM Continuation of a joint Kitsap County Board of Commissioners/City of Bremerton Council public hearing at the City of Bremerton Council Chambers, 239 4th Street, Bremerton, WA, to consider testimony specific to population allocation on the Kitsap County Sub-Area Plan, Port Blakely Joint Planning Area. The Draft Sub-Area Plan proposes a 440-acre mixed- use project west of Kitsap Lake and east of Dickerson Creek in Central Kitsap County. The property is located in unincorporated Kitsap County and designated as a "joint planning area" (JPA). The Draft Sub-Area Plan proposes that the property be included in the urban growth area (UGA) for the City of Bremerton. If approved, the property would likely be proposed for annexation into the City of Bremerton following the adoption of the Sub-Area Plan. The public hearing also includes the related proposed actions of (a) adopting transitional zoning for the property within the sub-area and (b) approving a 3-party agreement between Kitsap County, the City of Bremerton and Port Blakely Communities.
