M I N U T E S KITSAP COUNTY BOARD OF COMMISSIONERS August 28, 2000 The Board of Commissioners met on the above-stated date. Present were Chair Tim Botkin, Commissioner Chris Endresen, Commissioner Charlotte Garrido, County Administrator, Malcolm Fleming, Acting Clerk of the Board, Rosalie Sadler and Deputy Clerk of the Board, Opal Robertson. ITEMS SET FOR TIME CERTAIN: 10:00) Meeting Called to Order with Pledge of Allegiance. 10:00) Employee Service Awards. Congratulations and Certificates of Appreciation/Plaques were presented to the following County employees for their many years of dedicated service to the County: Gayle Chipps, Auditor's Office, Susan Smith, Personnel & Human Resources, Kathy Cloninger, Department of Community Development and Patricia Kirschbaum, Department of Public Works. 10:00) "Bike Helmet" Safety Presentation by the Sheriff's Office. Sheriff Boyer introduced Shirley Weiss, of the DUI Task Force who said that the task force partnered with the City of Bremerton Dairy Queen restaurant for a joint "Saved By the Helmet" campaign. Weiss said that at a picture-taking session, she was told about the bike crash incident with Max. Bonnie Shamian, firefighter/paramedic presented a certificate, Saved By the Helmet t-shirts and water bottles to Max and his brother Sam for Max being responsible in wearing his bike helmet when he had a bicycle crash. 10:00) Kitsap Peninsula Visitor and Convention Bureau Update by Grant Griffin, Executive Director and John Clauson, Board President. John Clauson, Board President of Kitsap Peninsula Visitor and Convention Bureau, said that VCB had been working for several years to develop a marketing campaign for Kitsap County. He said that they had worked with various agencies and individuals who help develop the campaign and they had identified the target market. Clauson played three radio-marketing commercials for attracting tourists to the Kitsap Peninsula. He also said that they had developed brochures describing the peninsula that had been well received. Grant Griffin, Director Visitor & Convention Bureau, said that they were working with several hotels and resorts for expansion of the fall campaign and that if it generated enough interest they would continue for the spring campaign. He said that there were two visitor information centers, an increase in the visits to the web site and that 75,000 visitor brochure guides had been distributed at three state rest stops along the I-5 corridor and eight locations in Oregon. 10:00) A Public hearing to consider a Supplemental Appropriation increasing the budget of the Law Library Fund by $7,000 in order to appropriate both the revenue and expenditures associated with an increase in fees anticipated and an increase in expenditures for books, computer equipment and professional services. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve the supplemental appropriation, further that an Order be executed so stipulating. Motion carried unanimously. 10:00) B Public hearing to consider a closed record appeal filed by Rick Anderson, American Marine Bank of the Hearing Examiner's decision to approve subject to conditions a Conditional Use Permit for construction and operation of the West Sound Academy located on Hwy 305 in North Kitsap, Commissioner District No 1. (NOTE: AT REQUEST OF APPELLANT, THIS MATTER HAS BEEN WITHDRAWN). 10:00) C Continuation of a public hearing to consider the Policies and Procedures for the Kitsap County Right-of-way Vacations and Disposition of County-owned Land Ordinance. Discussion was held, comments called for and hearing no objection, a motion was made by Chair Botkin and seconded by Commissioner Garrido that the Board continue this matter to September 11, 2000 for additional public comments. Motion carried unanimously. OTHER BUSINESS AND CONSENT ITEMS: 1) MISCELLANEOUS ITEMS: A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board: A. Approve Minutes of August 21, 2000. B. Approve Warrant Nos. C. Adopt "Decision on Appeal" for the North Kitsap Fire & Rescue Fire Station #85 Conditional Use Permit. Motion carried unanimously. 2) DEPARTMENT OF PUBLIC WORKS: A. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Interlocal agreement between Kitsap County and The City of Poulsbo (KC-309-00) in the amount of $30,000 for construction of a recycling center. Motion carried unanimously. B. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the contract between Kitsap County and Washington State Department of Transportation (KC-401-00) in the amount of $204,938.65 for construction of a left and right turn channelization on SR 307 and related improvements, for Chair's signature. Motion carried unanimously. C. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the contract Amendment between Kitsap County and Total Reclaim (KC-163-97-C) in the amount of $55,000 for collection of white goods at drop box sites. Motion carried unanimously. D. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the contract Amendment between Kitsap County and Prospect Construction, Inc. (KC-555-99-A) in the amount of $39,722.38 for services on the Central Kitsap WWTP IIC Expansion Project. Motion carried unanimously. 3) DEPARTMENT OF PERSONNEL AND HUMAN SERVICES: A. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the contract between Kitsap County and Lutheran Social Services (KC-378-00) in the maximum consideration of $99,851 for Respite Care Services for the period of July 1, 2000 through June 30, 2001. Motion carried unanimously. B. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board adopt Resolution No. 154-2000* thereby appointing Deborah Howard to the Kitsap County Commission on Children and Youth for a three year term commencing August 28, 2000, and ending August 27, 2003, Commissioner District No. 2. Motion carried unanimously. C. A motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board adopt Resolution No. 155-2000* thereby appointing Ken Parker to serve on the Kitsap County Commission on Children and Youth for a three year term commencing on August 28, 2000, and ending August 27, 2003, Commissioner District No. 2. Motion carried unanimously. D. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the contract between Kitsap County and Sound Institute (KC-377-00) in the amount of 86,043 for the 2000-2001 Title V Senior Community Services Employment Program for the period of July 1, 2000 through June 30, 2001. Motion carried unanimously. E. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board adopt Resolution No. 156-2000* thereby reclassifying positions within various County Departments. Motion carried unanimously. 4) DEPARTMENT OF JUVENILE: A. Discussion was held, comments called for, a motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Contract Amendment between Kitsap County and State of Washington, Department of Social and Health Services (KC-533-99-A) in the amount of $121,931to provide funding for Juvenile Services in Kitsap County. Motion carried unanimously. B. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Interlocal Agreement between Kitsap County and State of Washington, Department of Social and Health Services (KC-395-00) in the amount of $561,406 to provide funding for Consolidated Juvenile Services, including At Risk, SSODA, CJAA, and CDDA. Motion carried unanimously. 5) DEPARTMENT OF PARKS AND RECREATION: A. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Lease Agreement between Kitsap County and David & Debola Dial (KC-363-00) in the amount of $625 per month for Guillemot Gove Caretaker Rental, for Chair's signature. Motion carried unanimously. B. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Purchase and Sale Agreement between Kitsap County Vern Knight and/or Judy Buffington (KC-425-00) in the amount of $351,450 for the acquisition of Three Springs property; for Chair's signature. Motion carried unanimously. 6) AUDITOR'S OFFICE: A. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board adopt Resolution No. 157-2000* thereby transferring computer equipment between various County departments. Motion carried unanimously. 7) SHERIFF'S OFFICE: A. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Collective Bargaining Agreement between Kitsap County and Washington State Council of County and City Employees, AFSCME, AFL-CIO (KC-416-00) for Sheriff's Corrections Department Sergeants. Motion carried unanimously. B. A motion was made by Commissioner Endresen and seconded by Commissioner Garrido that the Board approve and execute the Interlocal Agreement between Kitsap County and North Kitsap School District (KC-393-00) in the amount of $34,315 for School Resource Program. Motion carried unanimously. 8) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: (Please limit comments to 3 to 5 minutes) A. Dave Card, Home Rule Committee, thanked Commissioners Endresen and Garrido for their support of the Home Charter government. He also asked if Home Rule literature could be placed in the courthouse lobby. B. Matt Ryan, GOP, addressed the Board with concerns about the political free speech process for political candidates. C. Nadine Ross addressed the Board with concerns relative to comments from Ron Ross on the Right-of-way Vacation and Disposition of County owned lands Ordinance. She also questioned whether the shoreline workshop meetings were recorded. D. Scott Henden addressed the Board with concerns about the political free speech process and the issues addressed by citizens at the shoreline workshop meetings. E. Vivian Henderson said that the shoreline workshop meetings were very complicated and that the Federal government was issuing mandates without any scientific documentation. She believed that the Critical Areas Ordinance needed to be amended. 9) COMMISSIONERS/ELECTED OFFICIALS/DEPARTMENT HEADS: A. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the Resolution No. 158-2000* thereby appointing Suzy Duke to the Noxious Weed Board, Commissioner District No. 2 to complete a 4-year term ending December 31, 2003 vacated by Pam Moyer. Motion carried unanimously. B. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Garrido and seconded by Commissioner Endresen that the Board approve and execute the Lease agreement between Kitsap County and Marianne Stewart for the Olalla Boat Launch; for Chair's signature. Motion carried unanimously. C. Anita McGuire and Carol O'Hara, Kitsap County Fair Board members displayed WA State Fair Commission Awards received at this year's fair in the Weaving Department and in the Livestock Animal Division. Anita also said that she had enjoyed serving the Fair Board but that she would retire this year. Jim Ryan, Fair Board Chair said that this was a good fair, attendance and gross was up and that the Fair Board would miss Anita. D. Malcolm Fleming, County Administrator, thanked Debbie Baker and Tom Dudzic, Co-Fair Managers as well the countless volunteers who did a great job at this year's Kitsap County Fair and Rodeo. E. Recess to executive session on Monday, August 28, 2000 at the hour of 1:30 PM to discuss land acquisition. (THIS MATTER WAS CANCELLED). Public meeting adjourned.
