M I N U T E S KITSAP COUNTY BOARD OF COMMISSIONERS October 21, 2002 The Board of Commissioners met on the above-stated date. Present were Chair Tim Botkin, Commissioner Chris Endresen, County Administrator Malcolm Fleming, Clerk of the Board, Holly Anderson and Deputy Clerk of the Board, Opal Robertson. (THE BOARD OF COMMISSIONERS' PUBLIC MEETINGS AND PUBLIC HEARINGS ARE AUDIO AND VIDEO TAPED). ITEMS SET FOR TIME CERTAIN: 10:00) Meeting Called to Order with Pledge of Allegiance. 10:00) Recognition of Employee Service Awards. Congratulations and Certificates of Appreciation were presented to the following employees for their many years of service to Kitsap County: Erik Anderson, Administrative Services; Denise Anderson, Yvonne Wolff and Lori McPhee, Assessor's Office; Mary Duvall, Auditor's Office; Deanna Erstad, Commissioner's Office; Sally Evenson; Cooperative Extension, Barbara Zaroff, Public Works; and Donna Freeman and Harriette Lewis, Treasurer's Office. 10:00) A Proclamation/Resolution proclaiming October 30, 2002 as Weatherization Day in Kitsap County. Mary Brewer, Kitsap Community Resources, gave a brief overview of the proposed proclamation stating this program saves energy through advanced technologies and helps improve the energy affordability for low-income families of Kitsap County. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 175-2002* thereby proclaiming October 30, 2002 as Weatherization Day in Kitsap County. Motion carried. 10:00) B Public hearing to consider a Resolution to Vacate a portion of Harris Road SE that was deeded to Kitsap County by Fleet A. Hamby in 1994; said road located in South Kitsap, Commissioner District No. 2. Jim Barnard, Public Works Department, gave a brief overview of the proposed resolution stating Fleet Hamby deeded the portion of Harris Road to be vacated to Kitsap County in 1994. He said Mrs. Hamby who later built a house based upon the legal description of this parcel did not sign the deed. Barnard said in order to clear title, staff recommends the Board vacate that portion of Harris Road SE described in the right-of-way deed and Mrs. Hamby would then deed the east 15 feet of her property to Kitsap County, providing an adequate right-of-way width of 45 feet abutting her property and meeting the building setback requirements for her new house. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 176-2002* thereby vacating a portion Harris Road SE that was deeded to Kitsap County by Fleet A. Hamby in 1994. Motion carried. OTHER BUSINESS AND CONSENT ITEMS: 1) MISCELLANEOUS ITEMS: A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board: A. Approve Minutes of October 14, 2002. B. Approve Warrant Nos. 3021518 through 3022951 in the amount of $4,077,475.55. Motion carried. 2) PROSECUTOR'S OFFICE: A. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 177-2002* thereby establishing special revenue fund for Kitsap Special Assault Investigations and Victim's Services. Net Fiscal Impact: None. Source of Funds: N/A. Motion carried. 3) DEPARTMENT OF PERSONNEL AND HUMAN SERVICES: A. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 178-2002* thereby changing the title of a position in the Department of Administrative Services and creating a job-share in the Department of Community Development. Net Fiscal Impact: None. Source of Funds: N/A. Motion carried. B. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board approve and execute the contract with Peninsula College (KC-286-02) to assist in providing a radiological technician program for residents of the Olympic Consortium. Net Fiscal Impact: $0. Source of Funds: WIA Federal Pass-through grant in the amount of $31,000. Motion carried. 4) DEPARTMENT OF COMMUNITY DEVELOPMENT: A. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board approve and execute the employment contract with Carol Wilson (KC- 507-02) to serve as Administrative Services Supervisor in the Department of Community Development. Net Fiscal Impact: $32,500. Source of Funds: Kitsap County General Fund. Motion carried. 5) PUBLIC WORKS DEPARTMENT: A. A motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board approve and execute contract amendment with Parametrix, Inc (KC-499- 02A) for added signal design work to the SE Mile Hill Drive improvement project. Net Fiscal Impact: $481,887.80. Source of Funds: $308,887.80 Road Funds and $173,000 Federal Funds. Motion carried. 6) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: (Please limit comments to 3 to 5 minutes) A. Scott Henden addresses the Board with concerns about the Kitsap County budget. 7) COMMISSIONERS/ELECTED OFFICIALS/DEPARTMENT HEADS: A. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Endresen and seconded by Chair Botkin that the Board adopt Resolution No. 179-2002* thereby appointing Tyson Depoe to the Open Space Parks and Greenways Advisory Council completing a 3-year term resigned by Lisa Phipps. Net Fiscal Impact: None. Source of Funds: N/A. Motion carried. B. Recess to excessive session from 1:30 PM - 2:30 PM to discuss litigation issues and personnel issues. 8) BOARD OF COMMISSIONER'S COMMENTS: Chair Botkin announced that the Board would go into executive session from 1:30 PM through 2:30 PM to discuss litigation and personnel issues and did not expect to reconvene for further action. The portion requesting to be vacated is approximately 14,479 square feet or 0.332 acres, is unopened and is not expected to be of use for the County Road system, pedestrian uses or park/greenway purposes in the foreseeable future. The proposed vacation is located in North Kitsap, Commissioner District No. 1. 10:00) B Public hearing to consider an Ordinance establishing the Kitsap County Community Development Corporation and approving its charter and by- laws. 10:00) C Closed Record Appeal hearing to consider an appeal filed by James Lindsey of the Hearing Examiner's decision to support the Department of Community Development's Code Interpretation dated March 25, 2002. The appellant is contesting an interpretation of specific land use conditions of approval for the creation of the Appletree Point Short Plat. The Department denied the applicant's request to build outside of the designated building envelope and to retain a bulkhead. The project is located in North Kitsap, Commissioner District No. 1.
