M I N U T E S KITSAP COUNTY BOARD OF COMMISSIONERS August 26, 2002 The Board of Commissioners met on the above-stated date. Present were Chair Tim Botkin, Commissioner Jan Angel, County Administrator Malcolm Fleming, Acting Clerk of the Board, Kathy Brown and Deputy Clerk of the Board, Opal Robertson. (THE BOARD OF COMMISSIONERS' PUBLIC MEETINGS AND PUBLIC HEARINGS ARE AUDIO AND VIDEO TAPED). ITEMS SET FOR TIME CERTAIN: 10:00) Meeting Called to Order with Pledge of Allegiance. 10:00) Employee Service Recognition. Congratulations and Certificates of Appreciation were presented to the following employees for their years of service to Kitsap County: Pacita Payne- Information Services, Rick Kimble and Ed Iskra – Department of Community Development, Roberta Cunningham – Juvenile Services and Maaren Stroble – Sheriff's Office. 10:00) A Resolution proclaiming the last week in August through the last week in October, August 26 through October 31, 2002 as Kitsap Harvest Celebration in Kitsap County. Caryn Robertson, Kitsap Food and Farm Alliance, gave a brief overview of the history of Harvest Celebrations stating that such events are now being held throughout Western Washington and that Kitsap Alliance played a leadership role in this growth. She said Kitsap Harvest Celebration has become a way for the community farmers, consumers, chefs, farmer markets, businesses, families and individuals to seek out and enjoy the bounty of this region's foods and farms. Robertson highlighted some of the events that would be taking place during this year's celebration and then introduced a representative from the Howe Farm Stewardship Committee, a Harvest Week participant. Discussion was held, comments called for and hearing no objection, a motion was made by Chair Botkin and seconded by Commissioner Angel that the Board adopts Resolution No. 150-2002* thereby proclaiming the last week in August through the last week in October, August 26 through October 31, 2002 as Kitsap Harvest Celebration in Kitsap County. Motion carried. OTHER BUSINESS AND CONSENT ITEMS: 1) MISCELLANEOUS ITEMS: A motion was made by Commissioner Angel and seconded by Chair Botkin that the Board: A. Approve Minutes of August 19, 2002. B. Approve Warrant Nos. 3011995 through 3013027 in the amount of $4,000,989.66. C. Refer the following to the Prosecutor's Office and the Risk Manager: 1) Complaint and Summons filed by James K and Myung Park; 2) Claim for Damages filed by April Michelle Porter and 3) Claim for Damages filed by Mary I Burrus. Motion carried. 2) JUVENILE SERVICES DEPARTMENT: A. A motion was made by Commissioner Angel and seconded by Chair Botkin that the Board approves and executes the contract with Olympic Educational Services District #114 (KC-380-02) to provide substance abuse evaluation and treatment to youth who are found to be chemically abusive and who have received a chemical dependency disposition alternative order. Net Fiscal Impact: $0. Source of Funds: DSHS-Community Juvenile Services Grant. Motion carried. 3) DEPARTMENT OF PERSONNEL AND HUMAN SERVICES: A. A motion was made by Commissioner Angel and seconded by Chair Botkin that the Board adopts Resolution No. 151-2002* thereby downgrading a position in the Assessor's Office and deleting a classification from the classification table. Net Fiscal Impact: $14,423 projected salary savings for the year 2003. Source of Funds: None required. Motion carried. B. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Angel and seconded by Chair Botkin that the Board approves and executes the Interlocal agreement with Bremerton Parks & Recreation (KC-422-02) to provide summer camp services for children with development disabilities. Net Fiscal Impact: $0. Source of Funds: DDD-Family Support Grant in the amount of $10,000. Motion carried. C. A motion was made by Commissioner Angel and seconded by Chair Botkin that the Board approves and executes the Interlocal agreement with the Lower Elwha Klallam Tribe (KC-234-02) to provide improved mental health services to local Native American communities for the period of June 1, 2002 through June 30, 2003. Net Fiscal Impact: $0. Source of Funds: DSHS Mental Health Contract in the amount of $7,150. Motion carried. 4) PARKS AND RECREATION DEPARTMENT: A. A motion was made by Commissioner Angel and seconded by Chair Botkin that the Board approves the Waterline easement with the City of Poulsbo for a waterline through Snyder Park located along the western edge of the park property under the access road for the fields. Net Fiscal Impact: $0. Source of Funds: N/A. Motion carried. 5) OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: (Please limit comments to 3 to 5 minutes) A. Mr. Barker addressed the Board with concerns about unauthorized dumping at the Mountain View Cemetery. He also commented on past years events at the Kitsap County Fair. B. Vivian Henderson commented on the success of the Kitsap County Fair. 6) COMMISSIONERS/ELECTED OFFICIALS/DEPARTMENT HEADS: A. Discussion was held, comments called for and hearing no objection, a motion was made by Commissioner Angel and seconded by Chair Botkin that the Board adopts Resolution No. 152-2002* thereby appointing Richard Thornton to the Art Advisory Board to complete a vacated term ending December 31, 2003. Net Fiscal Impact: N/A. Source of Funds: N/A. Motion carried. B. Recess to executive session on Monday, August 26, 2002 to discuss personnel issues. 7) BOARD OF COMMISSIONER'S COMMENTS: A. Chair Botkin and Commissioner Angel both commented on the success of this year's Kitsap County Fair and Stampede. Public meeting adjourned at 10:40 AM. Chair Botkin announced that the Board would go into executive session at the hour of 1:30 PM until 2:00 PM to discuss personnel issues and did not expect to reconvene the public meeting for additional business after the executive session. The portion requesting to be vacated is approximately 14,479 square feet or 0.332 acres, is unopened and is not expected to be of use for the County Road system, pedestrian uses or park/greenway purposes in the foreseeable future. The proposed vacation is located in North Kitsap, Commissioner District No. 1. 10:00) Public hearing to consider a Petition to Vacate a portion of NE Anna Road filed by Todd and Ashia Mills. The portion requesting to be vacated is approximately 1,200 square feet (40 feet wide by 30 feet long) and abuts the petitioner's parcel. The road is unopened and is not expected to be of use for the County Road system, pedestrian uses or park/greenway purposes in the foreseeable future. Establishment of an easement will maintain an existing electrical cable in the vacation area and approval of the vacation will not deny access to the abutting property owners. The proposed vacation is located in Central Kitsap, Commissioner District No. 3 10:00) Public hearing to consider an Ordinance setting the speed limit for watercraft on Mission Lake. The proposed amendment will limit the speed of internal combustion engines using Mission Lake exclusively to a maximum of seven (7) miles per hour. 10:00) Public hearing to consider appeals filed by Ingrid Siedler, Monica Robbins, Marilyn Rafn, John & Linda Valley and Jon Day of the Hearing Examiner's second decision rendered on July 19, 2002 to approve with Supplemental Findings of Fact, Conclusions of Law and Decision on Remand from Superior Court a Conditional use Permit, Zoning Code Variance, Critical Areas Variance, Shoreline Substantial Development Permit and Shoreline Conditional Use Permit submitted by Jim & Cathy Hayes for the Hood Canal Oyster Processing Plant, an oyster processing plant fronting the northwest side of Seabeck Bay along the Hood Canal in Central Kitsap, Commissioner District No. 3.
