M I N U T E S KITSAP COUNTY BOARD OF COMMISSIONERS (Special Meeting) November 5, 2004 The Board of Commissioners met on the above-stated date. Present were Chair Patty Lent, Commissioner Chris Endresen, Commissioner Jan Angel, County Administrator Malcolm Fleming and Clerk of the Board Opal Robertson. (THE BOARD OF COMMISSIONERS' PUBLIC MEETINGS AND PUBLIC HEARINGS ARE AUDIO AND VIDEO TAPED). 11:00) Meeting Called to Order with Pledge of Allegiance. ITEMS SET FOR TIME CERTAIN: 11:00) A Memorandum of Understanding with The Suquamish Tribe (KC-370-04) regarding Impact Mitigation Fund Disbursement – payment of the County's costs for police services incurred as a result of the Tribe's gaming facility. Net Fiscal Impact: $16,000. Source of Funds: Suquamish Tribe. Staff Contact: Dennis Bonneville, 337-7145. (Note: This special meeting will be held in the Board of Commissioners Chambers, County administration Building, 614 Division Street, Port Orchard, Washington). Malcolm Fleming, County Administrator, gave a brief overview of the proposed Memorandum of Understanding stating that it provides for payment of $16,000 from the Suquamish Tribe for a portion of the County's cost associated with providing police service for the related activities required as a result of the Tribe's gaming facility. He said this payment is consistent with the Tribal State Compact Class Three Gaming provisions. Michele Hanson, Suquamish Tribe, reiterated that this is a part of the Compact requirement for impact mitigation and covers the years 1999 – 2002. She states the Tribe is pleased that they could reach this agreement. Discussion was held regarding how the amounts are determined, how much of the actual impact cost is the $16,000 covering, whether a Sheriff's representative attended the meeting, the Compact members consisting of the Tribe, WA State Gaming Commission and affected jurisdictions, were the actual impact costs covered and how will the fee structure be set for the years 2003-2004. Travis Baker, Bremerton Sun, questions whether this memorandum of understanding (MOU) is a replacement for the one in which the Board could not agree on earlier, whether the Board believes the Tribe's position on granting no portion of the funds is retribution for not reaching agreement on the other memorandum of understanding, whether there was a motive offered for retaining the entire $40,000 as opposed to granting a portion to the county as a directive from the Tribal Council and if there is to be no MOU is that a reference to this particular MOU or the previous MOU? A motion was made by Chair Lent and seconded by Commissioner Endresen that the Board approves and executes the Memorandum of Understanding with The Suquamish Tribe (KC-370-04) regarding Impact Mitigation Fund Disbursement – payment of the County's costs for police services incurred as a result of the Tribe's gaming facility.
