TITLE 17

In December of 2008 the Department of Community Development (DCD) completed changes to Title 17 Zoning “Use Table”. These changes included reevaluating the permissibility of certain uses that had previously been lumped together. One such use that was split out because of differing impacts was “Tourism Facilities, including outfitter and guide services, and seaplane and tour-boat terminals”. The Kitsap Board of County Commissioners (BOCC) adopted the use broken into the following:

1) Tourism facilities, including outfitter and guide services, and
2) Tourism facilities, including seaplane and tour-boat terminals.

The once-consolidated use was “C” or Conditional Use Permit (CUP) at that time, and the CUP remained with the outfitter and guide services.  The seaplane and tour-boat terminals were changed to “X” not permitted in the zone. There was no discussion about these changes. Staff notes these changes to be in error at the time of ordinance preparation and subsequent adoption. Code adoption would “Conditionally allow “tourism facilities, including seaplane and tour-boat terminals” by placing a “C” in the Use Table cells for the RHTW and SVC zones.  Underlying projects in this zone will continue to be reviewed and conditioned pursuant to all applicable county codes.
