RWIP REPEAL ORDINANCE

The Board of County Commissioners repealed the Rural Wooded Incentive Program on June 14, 2010.  Please click on the attachment above to view the repealing Ordinance.

In 2006, Kitsap County adopted the Rural Wooded Incentive Program as part of the 10-Year Update to the Kitsap County Comprehensive Plan. Subsequently, these amendments were appealed to the Central Puget Sound Growth Management Hearings Board (Hearings Board) case No. Suquamish II case No. 07-3-0019c. In August 2007, the Hearings Board order determined the programs were partially invalid and non-compliant with the Growth Management Act (GMA). The Hearings Board decision directed the County to resolve the following:

• Rural Wooded Incentive Program (RWIP) as it relates to the Wooded Reserve 40-Year time period for use, as well as maintenance of natural resource industries and the need for a discrete planning document harmonizing GMA goals;  
• Transfer of Development Rights (TDR) Program as it relates to the 40-Year period of development right reuse.

Executive Summary (April 1, 2009)

On February 13, 2008, the Board of Commissioners enacted Ordinance 407-2008, which addressed the Growth Board’s concerns and brought the RWIP program into compliance. Additionally, on February 13, 2008, the Board of County Commissioners deliberated and approved Ordinance 408-2008 which imposed a 180-day moratorium on the use of the RWIP due to further Board of County Commissioner concerns regarding RWIP.  Some of those concerns are:

(1)  management plans for privately owned permanent open space tracts, which also address forestry activities;

(2) increased minimum project size to ensure public and environmental benefits;

(3) increased maximum project size to increase potential flexibility in project development;

(4) connectivity of open space and trails;

(5) additional protections for critical areas;

(6) a requirement for the use of low impact development techniques; and

(7) mechanisms to address the perpetual nature of the open space.
