Hearings Board Remand


Project Scope

In September 2011, the Central Puget Sound Growth Management Hearings Board (Case No. 07-3-0019c) rendered a decision that Kitsap County must re-examine is Urban Growth Areas (UGAs) expanded during the 2006 Comprehensive Plan update process. This decision followed a five year legal challenge that ultimately went to the Court of Appeals and placed back to the Hearings Board for decision.  This Hearings Board order is limited in scope and focuses on two main issues:

  1. What is an appropriate minimum urban density for single family residential zones in Kitsap County. 

  2. What density should Kitsap use when calculating the amount of urban area or land capacity necessary to accommodate population growth through 2025.

These issues primarily apply to the low-density residential zones (Urban Low, Urban Cluster and Urban Restricted) and will require a reduction in the sizes of many of our UGAs. The UGAs impacted by the decision include:
Kingston (1.15 MB)
Silverdale (3.07 MB)
Central Kitsap (3.18 MB) between Waaga Way and Riddell Road
East Bremerton (3.82 MB)
West Bremerton  (2.99 MB)
Gorst (1.06 MB)
McCormick Woods/ULID#6 (1.43 MB)
Port Orchard/South Kitsap (3.92 MB)

June 2012—Commissioners Public Hearing on Draft UGA Alternatives, EIS and selection of Preferred Alternative

August 2012—Commissioners Final Decision and Adoption
