McCormick North

Review and Approval Process

The McCormick Land Company (GEM1 LLC) has submitted land use applications, plans and agreements for the development of McCormick North and other areas of the ULID #6 Sub-Area. These applications, plans and agreements include:

McCormick North Master Plan Phase 1

McCormick North Master Plan Phase 2

Open Space Plan for the ULID #6 Sub-Area

Transportation Plan for the ULID #6 Sub-Area

Developer’s Agreement for Open Space in the ULID #6 Sub-Area

Developer’s Agreement for Transportation in the ULID #6 Sub-Area

Developer’s Agreement for Stormwater Improvements in Master Plan Phase 2

Preliminary Plat (471 single-family units on 186 acres) within Master Plan Phase 1

Under Kitsap County Code, these applications, plans and agreements require various levels of approval, some of which would overlap. To consider each application separately would be complicated and confusing, and would likely result in potentially significant conflicts and misunderstandings. Kitsap County Code allows the County to classify development applications and it was determined that the best method, which allowed the most public input, was to have the Hearing Examiner conduct the open record public hearing (as is typical) and then make recommendations to the Board of County Commissioners.

In accordance with this process, the above items were reviewed by County staff and presented at the open record public hearing before the Hearing Examiner on November 18, 2004 and December 9, 2004. The Hearing Examiner then recommended the items for approval with 97 conditions. This recommendation is now going before the Board of County Commissioners for review. A closed record hearing will be held:

Since one open record hearing has already been held, state law mandates that any testimony presented at this hearing be limited to the facts in the record previously presented to the Hearing Examiner. This means that while the Board may allow testimony, No new evidence (facts not previously heard by the Hearing Examiner) may be presented at this hearing.
