from Fire Districts
The questions
listed below may be helpful to consider when reviewing referrals
from a fire district or department. These questions should be asked
for each individual incident or date of alleged violation in order
to assure that sufficient evidence exists to support each individual
incident.

Were prohibited materials
burned in violation of WAC 173-425-050(1)?

Was a prohibited
material listed in WAC 173-425-050(1) burned? |

If not listed, is
there evidence/testimony that the material when burned would
emit dense smoke or obnoxious odor? |

Who is the person
responsible for the outdoor burning?
 |
If the person
responsible is someone other than the property owner, why have
they been deemed responsible? |

Is there evidence
that they started the fire or that they were in control of the
property? |

Is there evidence of who
started the fire? |

Was the fire in progress
at the time the fire district responded? |
 |
If not, when did the fire
occur?
 |
If it is not known
when the fire occurred, what evidence is there regarding the
type of material that was burned and who should be deemed
responsible for the fire? |

Does the information from
the fire district contain statements from all witnesses, both fire
district staff and others, who may have evidence regarding the
outdoor fire? |
 |
Entry issues - in
responding to the fire, did the fire department have any problems
when entering the property?
 |
Were there any
signs, gate, or fences obstructing their entry? If so, why did
they enter? (Perhaps because the fire was in progress, or
population or structures were at risk) |

Did the fire
department personnel observe the fire from a public road? |

Were burn permits from the
fire district in effect for the date and location involved?
 |
If not, would the
fire district have issued a permit if an application had been
properly submitted? |

Did the outdoor burning
occur within the UGA? |
