ELIGIBILITY TO SEAL JUVENILE RECORDS

ALL JUVENILE  CONVICTIONS, DEFERRED DISPOSITIONS AND

DIVERSIONS

1)     WHAT TYPE OF OFFENSE ARE YOU SEALING?

·    
Class “A” Offenses – You can seal any class “A” offense if,
£
You have 5 years or more crime free[1]; and,
£
You have no convictions for Rape 1, Rape 2, or Indecent Liberties with forcible compulsion, and meet the other requirements below.

·   All others – All other offenses may be sealed if you have 2 or more conviction free[2], and meet the other requirements below.

2)     OTHER REQUIREMENTS:  In addition to the above requirements:
£
You must have no pending charges (seeking conviction or diversion),
£
You must not be required to register as a sex offender; and,
£
You must have paid full restitution in the case.

 

 

 

 

RIGHT TO SEAL DEFERRED DISPOSITIONS AT AGE 18

1)     DOES THE DEFERRED QUALIFY FOR AUTOMATIC SEALING?

·   Dismissed After June 6, 2012 – If your deferred disposition is dismissed after June 6, 2012, then the case will be administratively sealed after you turn 18 without further motion assuming the other requirements below are satisfied, including full payment of restitution when dismissed.

·   Dismissed Before June 7, 2012 – If your deferred disposition is dismissed before June 7, 2012, then your case is not subject to automatic sealing.  It is possible however that the court already sealed the case if you turned 18 years old after July 25, 2009.  If your deferred disposition has not been previously sealed, or is not subject to sealing under normal rules, then you still have a right to have the court seal the deferred disposition by motion as long as the other requirements below are satisfied.

2)      OTHER REQUIREMENTS – In addition to the requirements above:
£
You must be at least 18 years of age
£
You must have successfully completed your deferred with dismissal
£
You must not have been deferred on a charge of Animal Cruelty 1
£
You must have paid full restitution in the case.


[1] “Crime free” means no “adjudications” or “convictions” since the last date of release from confinement, including full-time residential treatment, if any, or entry of disposition.  RCW 13.50.050(12)(a)(i).

[2] No “conviction” since the date of last release from confinement, including full-time residential treatment, if any, entry of disposition, or completion of a diversion agreement.  RCW 13.50.050(12)(b)(i).

MY ENTIRE CRIMINAL HISTORY CONSISTS OF A SINGLE DIVERSION

1)     DO YOU QUALIFY FOR AUTOMATIC DESTRUCTION?

·   You Entered Diversion Before June 12, 2008 - No, but you can still file a motion to destroy the diversion record assuming the other requirements are satisfied.

·   You Entered Diversion On or After June 12, 2008 – Yes, your case will be automatically destroyed within 90 days of becoming eligible for destruction.  A case is eligible for destruction when, in addition to the other requirements, you also paid full restitution and have no pending charges (seeking conviction).

2)      OTHER REQUIREMENTS - To destroy a single diversion:
£
You must have no other criminal history;
£
You must turn 18 years old; and,
£ At least two years must pass since completing the diversion.

 

MY ENTIRE CRIMINAL HISTORY CONSISTS OF ONLY DIVERSIONS

 

You are eligible to destroy one or more diversion records if:
£ You have no other criminal history;
£ are at least 23 years old; and,
You have no pending charges.
