Settles Kass Funeral Home Lawsuit

ORCHARD, WA—Kitsap
County has settled a Complaint for Monetary Damages and Land Use Petition
with Kass Funeral Home Inc. for $85,000. The Settlement Agreement and
Release of Claims releases the county from all complaints and petitions in
the matter now pending in Pierce County Superior Court. The Kitsap Board of
County Commissioners is expected to ratify the agreement at their regular
meeting on December 12.
The
settlement is intended to help mitigate Kass Funeral Home, Inc.’s costs for
purchase, development, and reconstruction of a property on West G Street in
Bremerton for a proposed crematory. The agreement was designed strictly for
the purposes of compromising disputed claims and avoiding the expenses and
risks of litigation. It is not an admission of liability or wrongdoing on
the part of any party.
The
Kasses’ plan to build a crematory originally came to light in the fall of
2004, when Navy Yard City residents, Bremerton School District and the City
of Bremerton opposed locating a crematory in the mostly residential West
Bremerton neighborhood. While zoning for the property allows for a funeral
home as a permitted use, a crematory was not a permitted use.
