KITSAP COUNTY TAX FORECLOSURE SALE TERMS OF SALE 1. The opening bid includes all delinquent unpaid general real property taxes (2011 and prior), interest thru December 31, 2011, penalties and foreclosure costs. 2. Bids are to be made in increments of no less than $50.00, in even dollar amounts. The Treasurer may increase the increment amounts at her discretion. 3. The sale will be made by auction to the highest and best bidder for cash. This is a cash sale for the full amount of the final bid plus other fees described in paragraph 5 below. Cash, certified or cashier's checks, in U.S. currency payable to the Kitsap County Treasurer, will be accepted and bidder must pay in full at the time of the successful bid. Personal checks will not be accepted, nor any other form of payment not specified above. 4. The sale of each parcel shall be considered final and closed upon acceptance of the winning bid. Unsold properties will be offered a second time at the end of the sale and if there are again no bids, the property will be sold to Kitsap County. 5. The successful bidder will be responsible for payment to Kitsap County of $78.00 for the deed and recording fee. The payment for the deed and recording fees must be made at the same time as payment of the amount of the final bid price. A receipt for payment of the bid price and fees for the deed and recording is given at the time of payment. 6. The parcels are offered on a "where is" and "as is" basis, and the County makes no representation of warranty, expressed or implied, nor any guaranty of warranty, expressed or implied, as to the condition of title to any property nor the physical condition of any property or its fitness for any use or purposes. Bidders are further advised that certain properties may be subject to easements or use restrictions set forth in the Covenants, Rights, and Restrictions of certain plats, as well as in zoning and other land use controls. 8. Any certified check or cashier's check that is returned as non-negotiable by any financial institution for any reason whatsoever shall cause the sale of the subject parcel to be null and void. The property or properties shall be sold at a later date to be determined by Kitsap County. 9. A tax foreclosure sale extinguishes most types of liens and encumbrances on a parcel, such as a deed of trust, mortgage, contract, judgment or similar item. Not all types of liens and encumbrances, however, are extinguished by a tax foreclosure sale. For example, federal tax liens (I.R.S.) and local improvement assessment liens may remain on a parcel after sale. Liens may be disclosed in the title report that is generally available for review for each parcel prior to the sale. Each parcel is sold subject to all liens and encumbrances. Whether or not liens are disclosed in the title report, and whether or not liens are announced at the time of sale, the County assumes no responsibility for such items. It is up to each bidder to determine what liens and encumbrances may exist on a parcel and whether or not the liens will be extinguished by the tax foreclosure sale. 10. No Kitsap County employee or officer, or person who is an immediate family member of and residing with a Kitsap County employee, may bid at the sale, nor may such person as an agent or allow any agent to bid on their behalf. 11. No one claiming any right, title, interest or estate in the property may redeem on the day of sale or thereafter; EXCEPT, the real property of any minor or incompetent person may be redeemed at any time within three years after the date of the Tax Deed sale.
